2. Customer Obligations and Liability
2.1 Acceptable use
The Customer is solely and exclusively responsible for all data, content, applications and activities hosted or run on the Company's servers. The Customer guarantees that use of the services will always comply with the legislation in force in the Principality of Andorra and applicable international regulations.
2.2 Prohibited content and activities
It is expressly prohibited to use the Company's services to:
a) Host, distribute or transmit illegal, pornographic, xenophobic or racist content, content that incites violence or terrorism, or content that infringes third-party rights.
b) Send unsolicited email (SPAM), or any unauthorised bulk commercial communication.
c) Carry out computer attacks, exploit vulnerabilities, run hacking, port scanning, flood or DDoS tools, or carry out any activity that could harm third parties or the Company's infrastructure.
d) Host open mail servers (open relays), unauthorised mailing lists or anonymous proxy services.
e) Infringe third-party intellectual or industrial property rights.
f) Carry out cryptocurrency mining without the Company's express authorisation.
g) For Virtual Server (VPS) services: run applications that consume resources abusively and harm other customers on the shared infrastructure.
Breach of this clause entitles the Company to suspend or cancel the service immediately and without prior notice, with no right to a refund of any amount.
2.3 Security and credentials
The Customer is responsible for keeping their access credentials (passwords, SSH keys, etc.) confidential and for all actions performed using their account. The Company will not be liable for consequences arising from unauthorised access caused by the Customer's negligence.
3. Intellectual Property Rights in Content
The Customer declares that they own or hold the necessary licences for all content hosted on the Company's servers, and that it does not infringe third-party rights. The Customer grants the Company a non-exclusive, limited and revocable licence to reproduce the data solely to the extent necessary to provide the service.
4. Limitation of the Company's Liability
4.1 The Company will not be liable for direct, indirect, incidental, special or consequential damages, including but not limited to loss of profit, loss of data, business interruption or non-material damage arising from the use of, or inability to use, the services.
4.2 The Company undertakes to maintain access to the services with a monthly availability target of 99.5%, excluding interruptions due to scheduled maintenance, force majeure and circumstances beyond the Company's reasonable control.
4.3 The Company assumes no liability for content hosted by the Customer or for the Customer's use of the contracted services. Any liability to third parties arising from the Customer's content or activities rests exclusively with the Customer.
4.4 Under no circumstances will the Company's total liability to the Customer exceed the amount corresponding to 3 months of the contracted service.
5. Backups
5.1 The Company makes periodic backups of its infrastructure as an internal preventive measure. These backups are made for operational purposes and recovery from system failures, but do not constitute a guaranteed backup service for the Customer.
5.2 The Customer is responsible for maintaining their own backups of hosted data and content. The Company does not guarantee recovery of data lost due to Customer errors, external attacks, or any other circumstance unrelated to a hardware or software failure in the Company's own infrastructure.
5.3 Restorations requested by the Customer may be subject to an additional charge and to backup availability at the time of the request.
6. Prices and Payment
6.1 Service prices are those published at HostingAndorra.com when the services are contracted. All prices are stated in euros (EUR) and, unless otherwise indicated, do not include applicable taxes.
6.2 The Company reserves the right to change service prices with at least 30 calendar days' prior notice. If the Customer does not accept the new rate, they may terminate the contract without penalty within that period.
6.3 Payment must be made in advance for the period selected by the Customer (monthly, quarterly, half-yearly or yearly). Failure to pay by the due date may result in suspension of the service and, after a further 15 days, permanent cancellation and deletion of the data.
6.4 No refunds will be issued for unused periods, except where expressly provided for in these Terms or required by law.
7. Duration and Automatic Renewal
7.1 The contract will last for the period selected by the Customer when the services are contracted (1, 3, 6 or 12 months).
7.2 Unless the Customer gives notice of their intention not to renew at least 15 calendar days before the expiry date, the contract will renew automatically for the same period at the price in force at the time of renewal.
8. Suspension and Termination of the Contract
8.1 The Company may suspend the service immediately and without prior notice in the event of a serious breach of these Terms, particularly those set out in clause 2.
8.2 Either party may terminate the contract by giving 15 calendar days' written notice.
8.3 If the contract is terminated due to a breach by the Customer, the Company will not be required to refund any amount paid.
8.4 Once the contract has been terminated, the Customer's data will be deleted from the Company's servers within a maximum of 30 days, unless retention is required by the legislation in force.
9. Confidentiality
Both parties undertake to treat all information obtained in the course of the contractual relationship as confidential and not to disclose it to third parties without the other party's prior written consent, except when required by a competent authority.
10. Personal Data Protection
The processing of the Customer's personal data is governed by the Company's Privacy Policy, available at HostingAndorra.com/privacitat.php, and by Andorran personal data protection regulations (Qualified Law 29/2021 of 28 October on personal data protection), as well as Regulation (EU) 2016/679 (GDPR) to the extent applicable.
11. Changes to the Terms
The Company reserves the right to amend these Terms at any time. Changes will be notified to the Customer by email at least 30 days in advance. If the Customer continues to use the services after that period, they will be deemed to have accepted the new terms. If they do not accept them, they may terminate the contract without penalty.
12. Applicable Law and Jurisdiction
These Terms will be governed by and interpreted in accordance with the laws of the Principality of Andorra. For the resolution of any dispute arising from or relating to this contract, both parties expressly submit to the jurisdiction of the Courts of the Principality of Andorra, waiving any other jurisdiction to which they might be entitled.
